I.General Provisions

This Privacy Policy describes the rules for the processing of personal data by the Controller in the “BreedCode” service, available at breedcode.com, including the legal bases, purposes and periods of such processing, as well as the rights of data subjects. This document also sets out the rules for the use of cookies and analytics tools.

Important distinction: This Policy concerns the processing of data of Service Users (Breeders). For personal data of third parties (e.g. breeding customers) visiting websites created using the BreedCode website builder, the Controller of that data is the User (Breeder) directly, while Evolved Sp. z o.o. acts solely as a processor providing the technical infrastructure (hosting).

II.Data Controller

III.Data Protection Officer

The Controller informs that it has not appointed a Data Protection Officer and performs the related duties itself. Contact: rodo@breedcode.com.

IV.Legal Bases for Data Processing

• The person has consented to the processing of their data.
• Processing is necessary to conclude and perform a contract.
• Processing is required to comply with a legal obligation (e.g. accounting).
• Processing is necessary for purposes arising from the Controller’s legitimate interests (e.g. pursuing claims, analytics).

V.Purpose, Scope and Basis for Collecting Data

• Entering into and performing an agreement for the provision of electronic services (SaaS/Hosting).
• Registration and management of internet domains.
• Making contact details available for presented breeding programmes.
• Direct marketing of the Controller’s own products or services.
• Processing payments.

The processed data include, among other things, IP address, full name, email address, telephone number, home or registered office address. For companies, this also includes the company name and Tax ID (NIP). Providing data is voluntary, but necessary for the provision of services.

VI.Purpose, Basis and Period of Data Processing

• Performance of a contract – Art. 6(1)(b) GDPR.
• Accounting – Art. 6(1)(c) GDPR – 5 years.
• Claims – Art. 6(1)(f) GDPR.
• Direct marketing – until an objection is raised.
• Newsletter – until consent is withdrawn.
• Analytics – for the period during which the Controller’s interest exists.

IX.Cookies and Analytics

The Service uses cookies for technical and analytical purposes. Google Analytics is used. Data may be transferred to the United States on the basis of appropriate legal safeguards.

X.Changes to the Privacy Policy

The Controller reserves the right to amend this Privacy Policy. The current version of the document is always available in the Service.
